ATF Ruling 10/9/2026 and Nebraska State Law

I will preface my thoughts with this: I am not an attorney or government official whether it be local, state or federal at all. I do not and am not giving any legal advice, and everything I say is for discussion purposes only so we can all talk about what the ATF ruling could mean to us as Nebraska residents. I as well as you just want to continue to follow the law and enjoy our constitutional right to bear arms, so we discuss it. I highly suggest you do your own research for specifics and clarifications, and talk to your own lawyer about it. This post is simply a discussion.

In addition to that, my significant other is an attorney in Nebraska. We have went over the Nebraska law, the ATF ruling, and also discussed it with their colleagues in length this morning. I will share opinions that were given to me.

I already know many of you will think "bro, we can just slap stocks on our pistols now and we're good to go, why are you getting so deep about it." Well, because laws are one thing, it's another to understand interpretation. It's important to have clarity and confidence.

https://www.atf.gov/news/press-releases/atf-issues-guidance-national-firearms-act-transfers-short-barreled-rifles-short-barreled-shotguns-suppressors-and-certain-other-firearms

The ATF has basically stated they do not require us to go through the NFA anymore to possess an SBR or suppressor. Now going forward, in order for us to acquire a suppressor or SBR legally, we have to fill out a 4473 and get approval through an FFL. Basically, an SBR and suppressor are treated like standard legal gun transfers. An important thing to understand here, is we still have to follow state law. The ATF no longer has the NFA requirement in place, and state law must be followed regarding SBR and suppressors.

https://nebraskalegislature.gov/laws/statutes.php?statute=28-1203

This is why your dog got no sleep last night even after the ATF ruling. Please read carefully (1) and (2) then the annotations below it.

(1) Clearly states that we here in Nebraska cannot posses an SBR.

BUT!

(2) Lists the provisions, stating who can legally possess an SBR. Obviously that is police, Nebraska National Guard, etc... the obvious. Then we are mentioned, "or persons qualified under the provisions of federal law.." which is where interpretation and debate enter the picture.

This is how you as a Nebraska resident legally possessed an SBR. You became a "qualified person" by going through the NFA and submitting your documents and did the engraving, blah blah blah.

No matter how much it infringes on our constitutional rights, or how blatantly stupid the NFA is as a whole- we abide to federal and state law because we like our dog being alive and don't want to go to prison.

Now, what makes us a qualified person since the ATF ruling?

I know my thoughts right after the ruling came out was this: I am now a qualified person because I have my permit in Douglas county, can pass a 4473, and can legally slap a stock on my pistol.

But this is where my partner and their colleagues as attorneys started debating the interpretation of Nebraska state law listed above. This is what they do for a living obviously.

One stated "well I interpret qualified persons as Nebraska residents that legally can own and possess firearms, they can now SBR their pistols legally in the state. Especially since qualified persons means those who followed state and federal law previously using the NFA requirements. Now they don't have to deal with the NFA regarding suppressors or SBR."

Another said "I interpret qualified persons as persons related to police, National Guard, and other similar city and state agencies, there mentioned, and not just every day Nebraska residents who can legally own and possess firearms."

Our Nebraska Attorney General is Mike Hilgers, and everyone was in agreeance that he needs to put out a statement in regards to the ATF ruling on 10/6/2026 and how it relates to Nebraska state law. He currently has not to my knowledge as of this post.

https://x.com/NEAttorneyGen

https://ago.nebraska.gov/

Feel free to reach out to him/his office and ask for guidance and clarity. I know many attorneys will be, as well as Nebraska residents. But the more people who do, the more likely he will put out a statement. Many other state AG's already have. Especially those anti-American ones who were quick to say the ATF ruling doesn't apply to them.

What are your thoughts? I for one think this current ATF director deserves his roses. He's been subjective. However he will likely be replaced in 2 years from now and everything currently happening could easily be reversed down the road in a few years.

One thing I'll say is my partner, again who is an attorney knows very little about guns in general. Something that struck me was when they asked me, "why does any of this matter? what's the difference between a pistol and a rifle?" -- for fucks sake we have been asking this for years as legal gun owners. My partner is absolutely confused and lost on why the NFA even exists, and why the ATF and states have made rulings and laws that are so convoluted and in basic words absolutely ignorant. For my partner to say and ask me this, knowing jack shit about guns or how to use them says everything you need to know about the NFA and ATF as a whole. "Pistol braces are incredibly stupid and a clear violation of our rights." Yes, yes we know.

Looking to get my first can and am curious who you guys use in the Omaha area. I have the photo and EFT/prints already, but they’re digital.

I’m also leaning towards capital armory since they take care of everything and send it straight to you.

BigShots Sale-Lincoln

Has anyone been to BigShots in the last few days? I see they are discounting inventory due to the store closing/moving to new owners. Any of their deals worth the time to drop in? Unsure how their prices compare to other stores/online. They posted on FB stating 20% store wide and 30% off magazines.

Looks like Sunday 9/13 is their last day open.

NFA dealers doing Non form 4 transfers?

I have called a few dealers and seen some FB announcements, all are saying they are holding off for more information to come out. Does anyone know of a dealer that is doing suppressor or SBR transfers with only the 4473 in the Omaha or Lincoln area?

Where can I see the Osight SE in person?

Been hearing a lot of good things about this optic. I understand a lot of people are gonna hate on the company but if you search across Reddit the newer optics are performing well.

I have a double astigmatism and want to look through the SE before purchasing. Worst case I can just use Amazon and return it but I’d rather not go through the hassle.

Every Holosun I look through (pistol dots) starburst really bad and are basically useless to me. The Vortex Defender CCW looks good to my eyes but is not enclosed. I do know they make an enclosed version but want to look through the Osight SE first.

Anyone know a retailer or shop that has them that would let me see through it?

Ranges around/near Omaha?

There was public land in Oregon we could go to lay in the dirt, set up your own targets and just train or dump brass. How about here near Omaha?

If no public land, what about a good outdoor range? Thanks.

Traveling through Nebraska; any recommendations on ranges, food and sights to see?

Hi everyone! I'm going to be traveling through Nebraska in August on a road trip to attend a funeral. I want to break up the monotony of the long drive (several thousand miles) by stopping off at recommended food stops, historical/scenic points of interested and public shooting ranges.

As far as food goes, I'd like to stop at places off the beaten path and offer good food you'd find from the TV show Diners, Drive-Ins and Dives.

As far as the ranges go, I'm looking for ranges open to the public that offer rimfire or long range shooting. Where I am at we don't have distances greater than 300 yards so I'd like to get in some time on ranges at further distances to test my DOPE.

I'd also be interested in A) varmint hunting (prairie dog?) if that's something doable in your state for an out of state resident and B) any shooting competition/matches.

I'm open to suggests anyone has for those various topics, especially food. I'd like to stay out of cities and urban areas. I haven't planned my route yet, but I intend to stay off the interstate as much as possible. I want to see America, not bypass it. I am already familiar with FOPA and traveling so my bases will be covered there.

Backpack carry an SBR??

I live in Nebraska, plan on getting an MK18 and putting a maxim defense gen 7 cqb stock on it. They have a gen 7 brace aswell, but the stock is more sturdy and would be preferred. Would like to carry it as a backpack gun. Is this legal?

Destructive Device FFL?

Trying to see if there are any type 09 FFL's in the state, looking to possibly pick up a 40mm launcher. I checked the ATF registry but could only find a 10 which was the Hornady plant in Grand Island, I also read that if there were none within a reasonable area the ATF would allow an SOT to conduct the transfer? Anyone know of any?

NFA transfer fees of Omaha metro FFL's?

Yea, me again. Sorry. Buying my first can online real soon and it's not through silencer shop.

I have read stories online of FFL's across the country charging 100-200 bucks to transfer a can and frankly that's some form of crazy I don't wanna deal with. Especially already paying $200 to alphabet boys in a legal theft money grab to have something I am entitled to have to begin with.

Question is- who is easy to deal with and has a reasonable transfer fee on cans? Also, this is my first time buying a can and need to read up on the process so if you have any info or tips I greatly appreciate it. Thank you.

Buying first suppressor- Which FFL to use in Omaha area?

I'm not using SilencerShop in this purchase. Having never owned a suppressor before I know I'll have to pay a tax stamp and fill out a form- which FFL in the Omaha area will make this as painless as possible for my first time?
