Deposit at risk.
Habyt Frankfurt ex-tenant here. I moved out at the end of July. Contract says that they will pay back the deposit within 8 weeks.
We are currently on the 11th week🤡
They answered to my email like “The deposit refund is processed in the 8th week after the contract end date. We are currently experiencing a high volume of deposit repayments, so there may be a slight delay, but the situation is under control. We appreciate your patience while we finalise the last checks before the refund is released.”
But it seems like they ain’t gonna pay back this amount in a couple of months at least.
Do I need to proceed with Mieterschutzbund? If yes, which one?
Any suggestions?

Did you move out at the end of the contract?

wait they said 8 weeks after the contract end date not move out date? that's shady. if your contract ended in july then even by their own weird math you're past the deadline
mieterschutzbund is probably your best bet here. doesn't really matter which one, just join one in frankfurt and they'll handle it. the membership fee is way less than losing your deposit
also send them a formal letter with a deadline. like 2 weeks to pay or you escalate. companies like habyt tend to move faster when there's actual pressure

In most cases, the end date and moving out will be around the same date. But based on the post it’s unclear whether it is the case here.
Without knowing it, it’s hard to say if there is Verzug or not.
Often, Mietervereine won’t assist for rentals that ended before the membership started, so OP better checks this out before enrolling.

Letter “Mahnung“ per Einschreiben Einwurf, deadline 14 days, wet ink signature.

According to their ratings they are bankrupt and you will very likely not see your deposit.

Habyt is a scam. I have tried my best over the past 1.5 years to scream and shout about their shadiness, ever since I experienced their bullshit first hand.
Good luck to you.
