News A-G open to law change amid backlash to teenage rapist's sentence

From Canberra Times article;

https://www.canberratimes.com.au/story/9368808/tara-cheyne-flags-act-sentencing-law-reform-after-rape-ruling/

Article text below;

ACT Attorney-General Tara Cheyne says she is prepared to change the law on sentences handed down in the ACT's courts, as the government faces backlash after a convicted teenage rapist avoided jail time.

The ACT Director of Public Prosecutions is also considering an appeal of the 18-month suspended jail sentence.

Ms Cheyne said the government should not be afraid to ask whether sentencing laws struck the right balance between of punishment, deterrence, rehabilitation and community protection.

"We have to earn the confidence victim-survivors should have in our justice system through the way people are treated, the support they receive and the outcomes our system delivers," Ms Cheyne said.

"I am prepared to make changes to sentencing legislation where the evidence supports them."

The ACT Supreme Court this month handed a teenager who pleaded guilty to a rape charge an 18-month prison sentence, suspended upon him entering a good behaviour order. It means the boy will not spend time behind bars.

The then 16-year-old raped a girl he met at a house party last year and "used considerable force in pursuit of his own sexual gratification", Justice Andrew Muller said in a decision published last week.

The boy pleaded guilty in the ACT Children's Court, spent one day in custody and cannot be named because he was a minor at the time.

The charge of sexual intercourse without consent carries a maximum penalty of 12 years in prison.

The teenager had moved to Australia about six months before the attack and admitted the rape was his first sexual experience.

In determining the sentence, Justice Muller accepted the teenager's prior lack of sexual experience and "limited insight into societal norms in Australia" reduced his moral culpability.

The judge said his prospects for rehabilitation were "significantly improved" if he was allowed to remain in the community with close supervision.

The Sentencing Act mandates imprisonment for young offenders must be a last record and for the shortest appropriate term.

More than 4400 people have signed a Change.org petition calling for Justice Muller to be fired over the rape sentence.

"This decision not only undermines the severity of the crime but also sends a distressing message to other perpetrators - that such actions might only face minimal consequences," the petition said.

A judge can only be removed on the grounds of "misbehaviour or physical or mental incapacity" after an extensive process, including a judicial commission inquiry and an Assembly vote.

More than 200 people have also signed a Legislative Assembly petition calling for a public inquiry to examine criminal sentences in the ACT.

" All sexual violence causes profound and lasting harm. Sentences must reflect the gravity of offending, hold offenders accountable and provide meaningful deterrence," the petition said.

"Recent sentencing judgments have prompted concerns about whether wholly suspended prison sentences adequately meet these responsibilities."

The Canberra Liberals on Wednesday said they would push for a review of sentences.

"The Canberra Liberals are extremely aware of the fact that there is a growing disquiet in the community over what's being seen and certainly communicated to us as a series of outcomes from the criminal justice system that are far outside of community expectations," Opposition Leader Mark Parton said.

"Now, that issue has been highlighted in recent months by some very specific cases and we certainly believe that it's time to do something that allows the system to better deliver those outcomes."

The opposition also said it would call on the government to hand power to the Attorney-General to direct the Director of Public Prosecutions to appeal "manifestly inadequate" sentences.

The shadow attorney-general, Chiaka Barry, said the director would remain independent but the Liberals' proposal would give the government the power to convey community expectations.

"That's what community expects, that the Attorney-General should be able to issue a direction to the DPP to appeal a matter if the sentence is manifestly inadequate," Ms Barry said.

Ms Cheyne said she would not seek to influence the decision of the Director of Public Prosecutions on whether to appeal the sentence handed to the 16-year-old.

"The Director of Public Prosecutions has confirmed that she is considering whether to appeal the sentence. She is working within the statutory timeframe of 28 days to make that decision," Ms Cheyne said in a statement on Wednesday night.

Recommendations where to overnight in car

• Upvotes

hi everyone,
i am visiting a friend in Canberra and unfortunately cannot stay at her place for the night (sharehouse). I am travelling in a van with black out window covers, so can be pretty stealth.

Does anyone know of anywhere i could pull up for one night safely? I can’t seem to find any campgrounds nearby that aren’t ridiculously expensive.

thanks in advance!

Recommendations Eastern European Groceries?

• Upvotes

Hi all. I’d like to host a dinner for my friends and feed them some Eastern European foods (poppy seed / honey cake; Russian sweets etc). I was wondering if there’s a good deli/grocery store that stocks them? I know there was one in Tuggeranong that shut down. Thank you!

Glad I’ve delayed the planting of my tomato seedlings.

What are some Canberra based experience gifts you’d recommend? Something that would be enjoyable solo too, if possible.

Recipient is my wonderful, time poor husband in his 40s who’s had some health issues so something that would be relaxing and recharge the batteries. He’s into music, food, art, cooking, nature.

Any recs are much appreciated!

SEC=UNCLASSIFIED Missing Cat - Campbell

Post image
153 Upvotes

Note: This is a repost, as the original one was removed by moderators as I made the mistake of using a short URL to the last location Cleavie was seen. Thank you so much for those who commented with encouraging stories and helpful advice on how to find my Cleavie on the original post.

Its 4.30AM and I just came back from a second night of searching for my missing cat. I have done almost everything that has been recommended by the likes of RSPCA, Canberra Street Cat Alliance.

Posted on notice boards, distributed fliers, left my cat’s belongings and food out, went searching for her between 3-5AM, etc etc.

My partner and lovely neighbours who have been so helpful throughout all of this are saying its a waiting game at this point but I feel like I don’t deserve to feel well-rested until I find her.

For context: I brought her out in a harness and she broke out of it.

I’m optimistic (mostly because I need to be!) because unlike the country I’m originally from, Canberra has a great system of monitoring and catching strays - so there isn’t many cats out on the streets, and I would hope that means any cat sightings are reported.

Anyways I don’t really know where i’m getting at, and this is probably just sleep-deprived ramblings - but thank you for reading.

While i’m here, if you do spot a cat in your neighbourhood with these descriptions, do get in touch with me.

Name: Cleavie (after Cleaver Green in Rake)
Age: 1+ y/o
Colour: Ginger
Breed: Domestic Long Hair
Collar: Red with a bell.
Microchipped: Yes.
Desexed: Yes. She has a tattoo in her left ear for it.

LAST SEEN:
11/10/26: 20-26 Anzac Park, Campbell
12/10/26: Pocket park opposite Page St

Events How many are doing “Ride To Work Day” tomorrow?

I must be crazy but I’m riding Kambah to Mitchell (28.3km) and then back.
Before the Canberra moron brigade get all upset about bicycles on roads again - other than the first 50m on my own suburban street, to reach the bike path - the entire trip is all on bike paths.

Anyone else doing the challenge? I’m combining it with The Great Cycle Challenge where I’m raising money for the Children’s Medical Research Institute, who are trying to fight childhood cancer.

Light Rail TIL Canberra light rail stage 2a costing same per km as European subways

This just came up on my feed and I’m honestly stunned. These costs are for underground subway lines through very high density cities with really expensive land values. How is this cost (~$240m USD per km) possible? 😐

I forgot to take a photo but it's the same vibe as this AI flyer they posted to Facebook. Literally one of the most photographed locations in/around Canberra and they used AI for their graphics????? It's mindboggling. EDIT: If anyone is interested, Ive started the Instagram page @CanberraAIboycott

Does anyone know the significance of the Palestine flags being flown along Kings Avenue today (14OCT)? I can only tie it to the Global Day of Action, but that was on the 11OCT, and I definitely didn't see them up yesterday (unless they have been all week and I just didn't see).

SEC=UNCLASSIFIED Petition regarding recent suspended sentence for rape case

For those who are interested, there is a petition floating around about the recent rape case where the perpetrator was given a suspended sentence, despite the judge noting there were little signs of remorse or recognition of the crime.

I'm not sure 'fire the judge' is the right approach as my understanding is its more around case precedent and the legislation around youth offenders. But I feel regardless, it's valuable as a community to call out that rape is a serious crime and 'sexual inexperience' is not a valid excuse for continually raping someone while they beg you to stop.

I know this isn't perfect but feeling a bit helpless.

Events $5 Pizzas at new Johnny Gios tomorrow in Kingston

Just found out that they are doing $5 pizzas tomorrow at the opening of the new Johnny Gios in Kingston tomorrow.

It's my favourite fast food pizza joint and figure in this economy others would benefit to know.

I can't find any info out there if this is only for a specific time or any other limitations. If anybody else knows those details please share.

I've no association with them.

Been getting non stop $0 deposited notifications tonight.

I have a feeling it might be some kind of dodgy processing of the old providers database? One notification for each time I used it in the past?

Dismissed 20+ of them so far.

Super annoying.

Loud Bang Public School Dress Code

Curious to hear opinions from parents/guardians of students at a certain Belconnen public high school of the sudden heavy enforcement of their dress code. It was styled as a “quick reminder” in the email welcoming families back to term 4, and I’ve heard some students found the way it was addressed at assembly this morning was heavy handed and upsetting.

Hi everyone, I will soon be taking a course paid for by my job at CIT in either

  • Certificate IV in ICT (Networking)

I was wondering which one I should take. Does anyone have any recommendations or experiences with them? What can I use them for in terms of the job market? I am interested in both, but I would like to know which would be best for employability and which skills would help me in the future.

Edit: tysm for the advice everyone, its much appreciated and has helped me alot!!
