Discussion Car insurance advice please!
Hello! I’m hoping someone might have some advice or experience with this.
I was recently in a car accident where someone rear-ended me. They were at fault and admitted liability. We both have comprehensive insurance, me with State and the other driver with AA.
Unfortunately, my car has been written off. I had an agreed value of $9,000, but State has told me they’ll deduct the remaining premiums owing on my policy from my payout
The frustrating part is that my policy renewed just 15 days before the accident, and I’d only made one fortnightly payment. As a result, I’m being told I need to pay approximately $1,300 in outstanding premiums, leaving me with just $7,300 from my $9,000 agreed value.
I’ve been insured for years and have never made an insurance claim or been involved in any other car accidents. This is the first time I’ve ever had to make a claim, and it wasn’t even my fault.
I understand this is in the policy wording, but it feels pretty unfair that I’m effectively paying for almost an entire year of insurance on a car I no longer have, especially when the accident was caused by someone else.
Has anyone in New Zealand been in a similar situation and successfully challenged this? Has anyone had any luck getting their insurer to waive or reduce the outstanding premiums, or recovering this cost from the at-fault driver’s insurer?
I spoke with a rep at state and she said the only thing to would be to make a complaint and go through the resolutions team, but that can take weeks - I just want to gauge what others experiences have been.
I’d really appreciate hearing about anyone’s experiences or advice on what options I might have. Thanks!
