A federal judge has blocked the White House from enforcing President Donald Trump's ban on CNN, MS NOW and Politico while their lawsuit over the ban moves forward.
Judge Timothy Kelly, who was appointed by Trump himself, extended his earlier order late Tuesday night with a preliminary injunction. The three news organizations keep their access while the case is pending, unless an appeals court lifts the order. Trump has vowed to appeal.
The dispute began on Sept. 18, when Trump announced he was barring the outlets over the way they cover him. The next day, reporters who tried to enter the security checkpoint found their hard passes, the credentials that allow entry, had been deactivated. The outlets sued, and the judge first issued a temporary restraining order that forced the White House to restore passes for dozens of reporters and other staff.
In the new ruling, Kelly found the outlets are likely to succeed on a due process claim and on two separate First Amendment claims. He also pointed to the president's own public remarks, writing: "President Trump's own comments suggest that he intended the revocation of Plaintiffs' hard passes to alter their reporting on him."
The judge said the decision should not be read to mean Trump's concerns about accuracy and fairness in news coverage are baseless, or that the government has no power to act when its real goal is protecting national security from unlawful leaks of classified information.
Theodore Boutrous, the attorney for all three outlets, said: "The harm this ban did to our clients, the First Amendment, and the public as a whole is profound."

Little Elio was smaller than a smartphone when rescuers found him, and his eyes hadn't even opened yet.
He was born in a Florida attic, where a homeowner had his mother trapped and relocated without realizing she had four babies.
Four days later, the homeowner heard chattering. By then, Elio was the only surviving cub.
Samadhi Wildlife Sanctuary took him in, and he was terribly weak.
His caretakers gave him fluids, vitamins, minerals, and warmth, and within days, he began showing signs of recovery.
Eventually, Elio grew strong enough to explore outdoors and prepare for life in the wild.
But during this process, he disappeared for several weeks and suffered an injury that left him struggling to walk. Returning to the wild was no longer possible.
Today, Elio has a permanent home at the sanctuary, complete with his own cozy nest.
And whenever he can't climb somewhere, he goes to his favorite caretakers, who have learned that he's asking for a little help.
They adore him, and they're always happy to lend a hand.
