Hi everyone,
I recently purchased an apartment in Sri Lanka. The full payment has been made, and we even took out bank loans to ensure that all the necessary legal checks were done and that the property documents were in order. The bank conducted its checks, and we also checked the relevant documents through the legal process. We couldn't find anything indicating that we would be responsible for any outstanding registration expenses.
Now, suddenly, the apartment management has started demanding Rs. 20 lakhs (LKR 2 million) from us. Apparently, this is money they spent on getting the apartment registered in the past.
Here is some background:
- The previous owner was the wife of the person who originally built the apartment building. Her husband passed away before all the apartments were sold.
- According to the management (other house owners), they did not recover these registration expenses from the previous owner at the time, and they are now asking us to pay them instead.
- We have a signed agreement with the previous owner stating that these kinds of previous liabilities or expenses cannot be passed on to us.
- None of this came up during the bank's document checks or our legal checks before purchasing the apartment.
The situation escalated after we requested a few maintenance-related things from the management, such as trimming some plants and addressing a few maintenance issues. They have now started demanding this Rs. 20 lakhs from us for expenses they say they incurred in the past.
My main concern is that we purchased the apartment in good faith, completed all the legal checks, and have a signed agreement with the previous owner. We were never informed of this alleged liability before completing the purchase.
I would appreciate advice from anyone familiar with Sri Lankan apartment ownership, condominium law, or property disputes.
- Can apartment management legally demand this money from a new owner if the expenses were incurred before the purchase?
- Does the fact that the previous owner was the wife of the original developer, and that the management apparently never charged her, make any difference?
- If our sale agreement states that previous liabilities cannot be passed on to us, does that protect us against this demand?
- What should our next steps be? Should we consult a property lawyer, request formal documentation of the claimed debt, or take some other action?
Rs. 20 lakhs is a substantial amount, and we don't want to pay money that we may not legally owe. At the same time, we want to handle this properly and avoid unnecessary disputes with the apartment management.
Any advice or experiences from people who have dealt with similar situations in Sri Lanka would be greatly appreciated. Thank you!
