North Carolina collision appraisal stalled because appraisers can’t agree on an umpire. How do I get one appointed?
I’m in North Carolina and looking for firsthand advice on getting an umpire appointed for an auto insurance appraisal.
My parked 2023 Tesla Model Y was hit, and there’s a disagreement over the repairs, including whether the tailgate needs replacement or can be repaired cosmetically. I’m currently going through the appraisal process under my own collision policy.
My independent appraiser and the insurance company’s appraiser cannot agree on an umpire. The other appraiser rejected my appraiser’s proposed candidates, and my appraiser rejected theirs because of concerns about their track records.
My appraiser initially said he would pursue a court appointed umpire, but now says I need to handle that myself.
Here’s where I’m stuck:
I called the magistrate’s office and clerk of court, but the people I spoke with weren’t familiar with the request.
I’ve had trouble finding an attorney who handles this type of issue.
My policy says the two appraisers will select an umpire, but it doesn’t explain what happens when they cannot agree.
I found N.C. G.S. 20-279.21(d1), which describes a magistrate selecting an umpire, but I’m unsure whether that procedure applies to an appraisal under my own collision coverage.
It’s frustrating because I’ve already hired an appraiser and followed the process, but I still don’t have a clear next step.
Has anyone in North Carolina successfully obtained an umpire appointment in this situation? Did you go through a magistrate or a judge? What paperwork did you file, and were you able to do it without an attorney?
I’d also appreciate recommendations for an attorney who represents policyholders in auto property damage appraisal disputes.

Man the whole appraisal clause setup gets real messy when the two appraisers dig in and refuse to agree on an umpire. I had a drawn out property claim a few years back and the umpire deadlock was the part nobody warned me about.
That statute you found is the right direction but it's written for liability claims against another driver's policy, not first party collision. It might still work as a fallback if you can convince a magistrate to apply it by analogy but that's a crapshoot without a lawyer.
If your policy is silent on what happens when they can't agree, the fallback in NC is usually a petition to the superior court for appointment of an umpire under the state's arbitration statutes. It's not a full lawsuit, just a special proceeding, and some folks manage it pro se with a simple motion. The clerk's office not knowing what you're talking about is unfortunately normal, you gotta ask specifically for the forms to initiate a special proceeding for appointment of an umpire or arbitrator and make them dig a little.
On the attorney front, look for a civil litigator who handles insurance coverage disputes or property damage, not just personal injury. They tend to know this corner of the process better than the PI guys who stay in the injury lane. The NC Bar referral service can narrow it down if you tell them it's a property damage appraisal impasse.

Omg honey it's a simple tesla worth less than $50k. Private appraisers are for rare or unique cars, not something off the factory lot. Jfc. Just because you drive a tesla doesn't make you special.

This is actually funny because the cost difference between repair and replace is very close to what you are likely paying out of pocket. If you hired an appraiser they are getting a percentage of the total cost of the repair which is why they want to replace everything and jack up the costs for everything the umpire will also cost you money and they can get expensive quick. Majority of people are going to side with insurance adjusters when they look at damage when you look at it do you think yeah that can be fixed by someone that fixes cars all day?

Wrong group for appraisal clause. They always get down voted. Like it doesn’t exist. See blow where the arrows are…..

just curious: did you show pictures or let anyone else look at the car? if so do they agree/disagree with the insurance or the appraiser as far as repair vs replace goes?

No I didn’t get anyone to take a look at it. It was already disassembled and I signed the agreement with body shop, which now looking back at it that was mistake #1.
