Drug Court in Rural Georgia
I have been in the criminal justice system in Georgia since I was 18. I am a non-violent low level drug offender. The worst conviction on my record is a First-Degree Burglary I committed when I was a teenager. I was sentenced to 10 years probation upon completion of RSAT. RSAT is essentially a rehab in a state prison. I was there in 2019 at Walker State Prison. The conditions were not great, but violence was not commonplace since we all had a release date. RSAT is usually a 50/50 mixture of inmates who have already been in and out of prison and younger people who were “spared” by the judge. This dynamic essentially makes the facility a recruiting ground for the gangs. They scout what they perceive to be young talent. I kept my head down and served 2 years.
Upon my release, I stayed sober for several years. My probation was set to expire in 2028. I relapsed and was arrested for Possession of Methamphetamine (2.2g - $20 worth) in 2026 after 8 years sober, and this was my first violation. I had done exceptionally well for those years in sobriety. I never failed a UA, I paid $14,000 in fines/fees/restitution. I worked 300 hours of community service.
Since I did so well, I was given the option to accept Mental Health Court (I am bipolar and relapsed after a manic episode.) where I am currently navigating the system all over again. I understand and am grateful for an attempt at rehabilitation (again) - but I think at least in my judicial district and small town the rehabilitation feels like a half measure. When you violate the rules of Mental Health Court (as set by the presiding judge) you are sanctioned and often sent to jail for 24-48 hours for minor infractions. Whenever you are sent to jail in this county, your mugshot is plastered all over Facebook like a digital stockade where you are ridiculed and mocked…. This erects another barrier in reintegration - and makes it hard to secure even an entry level job in an area with a 13% poverty rate.
The following are several infractions that can result in a sanction and public shaming:
- Possession of a Nicotine Vape
- Unapproved Romantic Relationships
(relationships are defined very loosely, after inquiring I found out that even a consensual one night stand is prohibited. if you violate this rule twice you will be terminated and go to prison.)
- Deleting messages from your phone. Any sort of deletion is seen as potential criminal activity.
(when I posed the hypothetical of receiving a text from a drug dealer, not responding, and deleting the message but forgetting to delete it from my deleted folder - I was told that does not matter and is still grounds for a sanction.)
- Energy Drink Consumption
(I know someone who went to jail for having an empty Redbull in his car. While I understand banning the consumption of Red Dawn/Tweaker energy drinks Redbull/Monster seems a bit extreme)
- Double Shot Espresso consumption
- Foul Language in Public
(I was told if someone reports you for cursing in public or at an AA/NA meeting - that since you are a reflection of the program this can result in a sanction.)
- DRC (this is a drug court adjacent program) received an email stating they were all banned from a certain AA/NA meeting. they were told if you attend that specific AA/NA meeting - you will be sent to jail. keep in mind this is in a rural area with a limited amount of meetings and you must attend 2-3 a week or be sanctioned, and many of us are poor. meetings are few and far between. it is incredibly disheartening to not only be barred from jobs, housing, voting, but even a free resource like an AA meeting.
I understand that I have made mistakes. I accept full responsibility for my crimes and truly wish to be better. This all just seems to not be proportional whatsoever. Georgia has one of the worst prison systems in the US - the DOJ released a full report I encourage you to read.
When redemption feels unobtainable, why even try? How am I supposed to sleep well - knowing that I am one small infraction away from public ridicule and ostracism all over again? I was told I would be getting a chance at rehabilitation - instead I am in a state of constant anxiety, fear, and paranoia. I have no urge to consume substances. I just have an urge to be free. I made a mistake that cost me my career, relationship, freedom, friendships, vehicle… and now the state offers what they deem to be mercy but it feels like just another cruelty.
Can any of you relate? What’s drug court like in your area? Does this seem extreme in your opinion or am I overreacting? Whatever you do - do NOT violate the law in a small town in the Deep South. It is insanity. This is a slave state.
