Talarico needs to sue for defamation.

He definitely should-hit them where it hurts and set a clear precedent.

Didn't they recently get sued for billions for lying?

There's already a precedent.

What they really need is a judge that isn't a corrupt Trump-appointed piece of shit.

Change of venue is still a thing.

Technically it wasn't just for lying, but for lying while having knowledge that it was a lie.

The hurdle for defamation of a public figure is actual malice, meaning either that you have to know the statements you're making are false, or that you made them with reckless disregard for the truth. It's a very hard suit to win. What helped Dominion is the many internal e-mails where people at Fox acknowledged that they knew what they were saying was false.

This would be a state claim, so no Trump-appointed judge. Still Texas, though.

Fox News is not the one making the mental hospital claim nor have they said one way or the other to its authenticity

It’s literally the only thing MAGA has against him, libel and slander. Easy case

Not just for money, but everyday by every host they need to say they were wrong and are sorry until election day.

He'd have to show that they knew it was false when they peddled the rumor. That's what did Fox News in during the Dominion lawsuit (there were texts where they admitted it was fake).

I think the plaintiff has to show damages to sue for defamation. Gonna be hard to convince a jury anyone who was going to vote for him changed their mind based on rumors and lies.

There is such thing as defamation per se, which requires no showing of actual damages. Accusing a political candidate of lying might reach that.

The difficulty will be in reaching the standard of actual malice. You have to prove they knew what they were saying was false, or that they acted with reckless disregard for the truth. It's a high legal bar to meet, and that's why public figures almost never sue for defamation.
