Talarico can file lawsuit to Fox if he wants to, since he has standing. Like Newsom last time.

Please give me a source if I'm missing it, but I don't think Fox ever published a story saying Talarico was in the mental health facility. Those stories were published by right-wing influencers.

Talarico may have standing and/or damages from those influencers, but not from Fox regarding this incident.

This is a post from Fox saying the viral mental health hospital story has been debunked, which is true. You can't win a defamation case against something that's true.

There could be a case for defamation if Fox said Talarico was in a mental health hospital when they knew he wasn't, but I don't believe they ever said that.

I see your point. In this case, Fox did not create the lie, they just help spread it instead of fact checking first like a normal journalist would do.
